Drumkeen driver who fled scene of collision is fined and disqualified

A Drumkeen man has been disqualified from driving after being charged in relation to a three-vehicle collision.

Gary Holmes faced charges in connection with a collision on November 21, 2022 at Callan, Drumkeen.

The 31-year-old, of St Bridget’s Terrace, Drumkeen, was before Letterkenny District Court.

Garda Garrett Monaghan told the court that he attended a three-vehicle road traffic collision on the date in question,

He said a white Ford Mondeo was taking a right turn at a staggered junction and a Ford Ranger came along and collided with the rear of the vehicle. The impact, he said, forced the white Mondeo into the path of an oncoming vehicle.

Holmes was charged with dangerous driving, contrary to section 53 of the Road Traffic Act, 1961.

He also faced two hit-and-run charges, one for failing to remain at the scene and one for failing to give the appropriate information. Those charges are contrary to section 106 of the Road Traffic Act, 1961.

Inspector Seamus McGonigle informed the court that Holmes has no relevant previous convictions.

The husband of the female driver of the Mondeo was in court and photographs of the damage caused were handed in to Judge Ciaran Liddy.

Mr Patsy Gallagher, solicitor for the accused, said that given the motor vehicles involved the collision “could have been a lot more serious”. He pointed out that his client was fully insured and said the guilty plea would be of assistance to the court.

Judge Liddy disqualified Holmes from driving for two years on the dangerous driving charge. Homes was also fined €150 and given six months to pay.

For failing to remain at the scene, Holmes was fined €250 and the other charge was taken into consideration.

Legal aid was granted to Mr Gallagher.
