A young Letterkenny man who waved his fists at Gardaí while topless during a drunken incident has been told to make a contribution to St Vincent de Paul.
Saul Miller appeared before Letterkenny District Court in connection with the incident on August 16, 2024.
Miller, a 23-year-old, of Kristenwood, Knockbrack, Letterkenny, approached Gardaí with his top off on Main Street, Letterkenny at 3am. Sergeant Jim Collins told the court that Miller “produced his fists as if he was going to try and box them”.
Sergeant Collins said Miller was “contrite and apologetic” when conveyed to Letterkenny garda station.
Miller was charged with a public order offence contrary to Section 6 of the Criminal Justice (Public Order) Act 1994 as amended by Section 22 of the Intoxicating Liquor Act, 2008.
Mr Rory O’Brien, solicitor for Miller, said this was an “incident that got out of hand”. He said his client had his top off due to his drunkenness and his fists had been produced “in jest”.
Mr O’Brien said his client is apologetic and had as “unblemished a record as possible”.
Sergeant Collins confirmed to the court that there was nothing of concern to Gardaí relating to Miller.
Judge Éiteáin Cunningham ordered Miller to make a €200 contribution to St Vincent de Paul in order to avoid a conviction. A default order of a conviction and a €300 fine was laid down.
Miller was remanded to appear again before Letterkenny District Court on November 4.
