Young brother and sister awarded €12,000 after Letterkenny crash

Two siblings who were back-seat passengers when the car in which they were travelling was rear-ended have each been awarded €6,000.

At Letterkenny District Court this week, Judge Éiteáin Cunningham approved the offers from the relevant insurers.

The plaintiffs were represented by barrister Mr Simon Gillespie BL, instructed by solicitor Mr Fionntan O’Flynn.

The court heard that the girl was aged three when the collision, described as a ‘rear-ending type’, occurred in January of this year and the boy aged nine.

The court heard that both were restrained passengers in the back seat of a vehicle which was involved in a collision in Letterkenny.

Mr Gillespie said the girl was ‘shook’ as a result of the incident and experienced a couple of nights of ‘fearfulness and anxiety’ and was anxious while travelling for a short period afterwards.

Apart from this, Mr Gillespie said the girl had sustained no physical injuries and the psychological sequelae were noted as being normal when she visited her GP in March.

Mr Gillespie told the court he was strongly recommending the offer of €6,000 from the insurers and Judge Cunningham said she was satisfied to approve the offer.

Judge Cunningham said the offer represented “a positive settlement for the child”.

The boy had a similar experience, but also suffered some nights of sleep disturbance and had what was described as a mild soft tissue injury following the collision.

When he was seen by his GP in March, the doctor noted no ongoing concerns.

Mr Gillespie said the offer of €6,000 from the insurers was “an excellent offer” and he had no hesitancy in recommending it.

Judge Cunningham approved the offer and in the case of each District Court costs, to include a certificate for legal counsel, were also approved.
