Man to stand trial over death of Letterkenny pensioner

A Buncrana man has been returned for trial on a charge of dangerous driving causing the death of a Letterkenny pensioner.

A book of evidence was served on Shaun Duffy at Letterkenny District Court.

Garda Gillian Page gave evidence of serving the book on Duffy, a 49-year-old from Trillick, Buncrana, at 10.45am on Monday.

The court heard that Duffy made no reply.

Sergeant Jim Collins told the court that the Director of Public Prosecutions (DPP) has consented for the accused to be forwarded to the present sitting of Letterkenny Circuit Court.

Duffy is charged with dangerous driving causing the death of Mervyn McClure. The charge is contrary to Section 53 (1) of the Road Traffic Act of 1961.

Mr McClure passed away following a three car collision on July 5, 2022 on the N13 road at Sharon Glebe, Newtowncunningham.

The late Mr McClure, from Lurgy in Letterkenny, was in his 70s at the time he was killed in the tragedy.

Sergeant Collins said there are summary matters that will be linked to the indictment.

Judge Éiteáin Cunningham made an order returning Duffy for trial. Duffy was administered with the alibi warning and a section 56 order, relating to videos of interviews, was also made.

Legal aid was granted to Mr Frank Dorrian and two legal counsel were assigned. Duffy was remanded on bail on the same terms and conditions as are currently in place.

The matter was mentioned briefly at Letterkenny Circuit Court on Tuesday.

Judge John Aylmer made a witness and exhibits order and adjourned the case until the next session of Letterkenny Circuit Court.
