Two young Donegal cousins have been awarded €7,500 and €5,000 after being involved in a car crash.
The awards were approved this week at Letterkenny District Court.
Mr Tom O’Donnell BL, for both plaintiffs, outlined the matter before Judge Éiteáin Cunningham.
He said the accident occurred in February 2018 when the infant claimants were aged 10 and both were back seat restrained passengers.
One boy suffered neck and back pain which took some 11 months to fully subside. A medical report showed that he sustained a moderate degree of muscular injury to both his neck and back.
An award of €7,500 would be a ‘very good offer’, Mr O’Donnell opined. He said the boy did not need an x-ray, but missed a short time out of school and away from playing football.
Judge Cunningham said it was the court’s view that it was an ‘excellent offer’ and she had no hesitation in approving it.
The other boy suffered neck and back injuries and missed one month from school. Nightmares and bed wetting ceased after two months while he was inhibited by back and neck pain for around six months afterwards.
In this case, an offer of €5,000 was recommended.
Judge Cunningham said this represented a ‘very good offer’ and she had no hesitation in approving it.
In the case of each, costs of €300 plus VAT were also approved.
