January 25, 2024

A Judge has extended time for the service of a book of evidence in the case of a Glencolmcille man charged with a knife attack.

Adam McIntyre has been charged with offences relating to an incident in Glencolmcille last April.

At this week’s sitting of Glenties District Court, his solicitor, Ms Maureen Gallagher, was informed that the book of evidence was still not served.

“This has been adjourned on three occasions now,” Ms Gallagher told the court. “We are still waiting on the service of the book.”

Inspector Rosaleen Logue said the book was due to be ready, but ‘the weather conditions dictated otherwise’. Inspector Logue told Judge Éiteáin Cunningham that she was satisfied that the book was now ‘imminent’.

Ms Gallagher asked that the matter be marked peremptory against the State.

Judge Cunningham said she was not going to do so on this occasion and granted an extension of time for the service of the book of evidence. The matter was adjourned until February 28.

McIntyre, a 30-year-old of Marion Avenue in Glencolmcille is charged with assaulting Darragh O’Gara causing him harm, an offence contrary to Section 3 of the Non-Fatal Offences Against The Person Act 1997 at Cashel, Glencolmcille on April 23, 2023.

McIntyre is charged that while committing an offence, namely assault causing harm, that he produced a flick knife. He is further charged that he was in possession of a knife which had a blade or was sharply pointed.

Mcintyre is also charged that on April 24 at Ascal Mhuire, Glencolmcille, he had a ‘Morakniv’ black-handled knife and a ‘Victorinox’ black-handled knife, which had a blade which was sharply pointed.
