Grieving man caught cousin in ‘compromising position’ with girlfriend

A grieving man who went berserk after catching his cousin in bed with his girlfriend before his mother’s funeral has appeared in court.

Bernat Slawomir, 38, appeared before Letterkenny District Court charged with trespass and criminal damage.

The court heard that Slawomir had just lost his mother and that the victim had flown in from Poland to attend the funeral.

However, when Slawomir came home from making arrangements for his mother’s funeral he found his cousin in what his solicitor described as “a compromising position in the bedroom.”

Slawomir, of Beechwood Park, Letterkenny, is charged with two counts of criminal damage and also trespass at the home of his girlfriend at Ard Ban, Ballyboe, Glencar, Letterkenny on December 9th, 2022.

He is charged with trespassing at the address and also causing damage to a sitting room window and also two potted plants.

The accused man’s solicitor, Mr Patsy Gallagher, told Judge Eiteain Cunningham that the case arose from a “very unfortunate situation” between himself, his cousin and his girlfriend.

He said “The parties were together after the passing of my client’s mother. His cousin had arrived over from Poland for the funeral and my client had gone out to make arrangements for the funeral.

“When he returned he found his partner in a compromising position in the bedroom with the victim in this matter and the charges arise from that.”

Garda Sergeant Jim Collins told the court that a certain course is being taken in the case.

Judge Cunningham said that none of the facts had been opened to her and that this might be a case which would be appropriate for a Probation and Welfare Report to be carried out.

She adjourned the case until March 25th, 2024 for a plea or a hearing date.
