Men avoid conviction after ‘struggle’ with gardaí

Two men have avoided conviction after a ‘struggle’ with gardaí in Letterkenny town centre.

Frank Jeffrey and his nephew Joseph Kuyewawa, each with addresses at Premier Square, Finglas Road, Dublin, appeared at Letterkenny District Court this week.

Jeffrey had attempted to ‘thwart’ Gardai who were in the process of arresting his intoxicated nephew.

Sergeant Jim Collins told the court that Gardai observed 34-year-old Kuyewawa in an extremely intoxicated state at Pearse Road, Letterkenny.

Kuyewawa failed to cooperate with Gardai, who asked for his name and address. “He was too intoxicated to do so,” Sergeant Jim Collins told the court.

Jeffrey, a 33-year-old, attempted to intervene. Sergeant Collins told the court that Jeffrey tried to thwart Gardai when they were arresting Kuyewawa and there was a ‘struggle’.

Kuyewawa has no previous convictions while Jeffrey has a ‘number’ of previous road traffic convictions.

Solicitor Mr Patsy Gallagher represented both men. He said Kuyewawa was ‘very drunk’ on the night and Jeffrey ‘became concerned for his nephew’.

“He accepts that he shouldn’t have got involved,” Mr Gallagher said.

Judge Éiteáin Cunningham said that each man could avoid a conviction by making a €250 donation to St Vincent de Paul.

A default order of a conviction, with a €300 fine, was set down by Judge Cunningham.
