Letterkenny man in court on breach of peace charge

A man has appeared in court in relation to an alleged incident in Letterkenny on Wednesday.

Richard Mawhinney was brought before Thursday’s sitting of Letterkenny District Court.

Mawhinney was charged with alleged public order offences at Burnside Park.

Mawhinney, a 25-year-old of Burnside Apartments, Lower Main Street, Letterkenny, was charged that he did use or engage in threatening, abusive or insulting words or behaviour with intent to provoke a breach of the peace or being reckless as to whether a breach of the peace might be occasioned.

The offence is contrary to section 6 of the Criminal Justice (Public Order) Act 1994, as amended by section 22 of the Intoxicating Liquor Act 2008.

Mawhinney was further charged that he was present while intoxicated to such an extent as would give rise to a reasonable apprehension that he might endanger himself or any other person in his vicinity.

The offence is contrary to section 4 of the Criminal Justice (Public Order) Act 1994, as amended by section 22 of the Intoxicating Liquor Act 2008

Sergeant Jim Collins told the court that Gardai had no objections to bail. Mawhinney is on station bail.

The court heard that Mawhinney was suitable for legal aid and solicitor Mr Rory O’Brien was assigned.

Judge Éiteáin Cunningham adjourned the matter until October 23.
