A Letterkenny man has voluntarily gone to jail after withdrawing an appeal against his imprisonment.
Lee Mitchell appeared at Letterkenny Circuit Court on Tuesday to formally withdraw an appeal against a sentence imposed at the District Court.
Mitchell, a 42-year-old with an address at Windmill View, Letterkenny, was given a two-month prison sentence for offences committed in 2021.
While an appeal was lodged to the Circuit Court in respect of the sentence, Mitchell’s solicitor Mr Frank Dorrian informed the court that the appeal was being withdrawn.
Mr Dorrian said Mitchell is ‘a gentleman with a very troubled history’ who has ‘failed to demonstrate rehabilitation’.
Mitchell was charged with stealing a bottle of Captain Cook’s Spiced Rum valued at €16.79 from Lidl, Pearse Road, Letterkenny, on March 28, 2021.
The accused was also charged with stealing jambons and chicken wings valued at €5.85 from Dunnes Stores, Oldtown Road, Letterkenny, on March 29, 2021.
Mitchell was also charged with an offence on April 18, 2021 at Ean Eile Cafe, Justice Walsh Road, Letterkenny, where, having entered the building as a trespasser did commit an arrestable offence to wit theft therein.
Judge John Aylmer said the withdrawal of the appeal affirmed the District Court order, meaning Mitchell will go to prison for two months.
