A MAN charged with raping a woman in Donegal has been sent for trial to the Central Criminal Court.
A book of evidence was served on the man, who cannot be named in order to protect the identity of the alleged victim in the case, at Buncrana District Court today.
The 24-year-old man is charged with raping the woman at an address in Inishowen in June 2019.
The Director of Public Prosecution (DPP) has consented for the accused to be sent forward to the present sitting of the Central Criminal Court.
The man was charged with an offence contrary to Section 48 Offences Against the Person Act 1861 and Section 2 of the Criminal Law (Rape) Act 1981, as amended by section 21 of the Criminal Law (Rape) (Amendment) Act, 1990.
The accused man appeared for the brief hearing before Judge Alan Mitchell.
The man, with an address in Donegal, is not residing in the county at the minute.
Judge Mitchell administered the alibi warning and directed that the accused sign on twice a week at a named Garda Station. He is to have no contact, directly or indirectly, with the alleged injured party or her family.
Judge Mitchell directed a publication order be imposed to protect the victim’s identity from being revealed.
The accused, who is represented by solicitor Mr Frank Murphy, is to be contactable by telephone to Gardaí at all times.
The Court was informed that the accused planned to go on a holiday to Lanzarote later this summer. The man has not had to surrender his passport.
Due to the nature of the charge, Judge Mitchell said this was a matter for the Gardaí to ‘consider’.
