Four-year ban for coal delivery man who thought he was ‘on homeward straight’

Ivan Nicholl (33) had been disqualified for two two years in November 2019.

On February 5, 2021, Nicholl was detected driving at Tulnaree, Carndonagh.

On Tuesday, Nicholl, of Ballinahone, Fahan was arrested by arrangement on foot of a bench warrant and brought before Buncrana District Court.

He made no reply when the charges were put to him.

Defence solicitor Mr Frank Dorrian said his client ‘was observing the disqualification until this event’.

He said: “This wasn’t a chase situation. He was manoeuvring the vehicle to go back home.

“He was harbouring the idea that he would get his licence back at the halfway line, so to speak. He felt that he was on the homeward straight and he was as co-operative as could be.”

Mr Dorrian said Nicholl worked carrying coal around. “He is engaged in backbreaking work and he is industrious.”

For driving while disqualified, Judge Paul Kelly disqualified Nicholl for four years and fined him €250. For driving without insurance, Judge Kelly imposed similar penalties, which are to run concurrently.
