A BALLYBOFEY man who was ‘roaring and shouting for no apparent reason’ on the street after ringing in the New Year was fined in court for the possession of drugs.
Andrew McPhearson (20) of Dooish Ballybofey, was charged with possession of drugs contrary to section 3 of the misuse of drugs act.
At 00.38am on January 1, 2020, Gardaí were on patrol at Navenny Street, Ballybofey when they observed a young make ’roaring and shouting for no apparent reason’.
Gardaí directed him to desist. As officers pulled away, McPhearson shouted ‘you can fuck off’. Sergeant Jim Collins told Letterkenny District Court that McPhearson shouted ‘a number of other things that Gardaí were unable to make out’.
McPhearson was arrested and when searched a small amount of cannabis herb, valued at €20, was found in a tobacco pouch.
Solicitor for McPhearson, Mr Kieran Dillon, said that the incident had served as a wake-up call for his client.
“He was in a hole and should have stopped digging,” Mr Dillon said.
“His lifestyle has changed since the incident. He made admissions here and was co-operative.
“He hopes to go back to college to do something in sports science.”
Judge Paul Kelly gave McPhearson the option pay €150 to Planet Youth in Ballybofey and adjourned the matter until September 7.
