A leading barrister has said the Buncrana pub at the centre of Guinnessgate was NOT breaking the law.
O’Flaherty’s Bar hit the headlines this week after Gardai shut down their booze delivery service.
The popular Inishowen pub was delivering pints of plain to thirsty customers by car and bicycle in what was dubbed the Guinness Express.
But the taps were turned off when Gardai visited the bar and told the owners they could not continue to operate the service.
Twenty creamy pints ready for delivery were also seized during the visit on Saturday night last.
Amazingly the pints, which were in sealed pint glasses, were returned to the bar two days later on Monday.
Now leading barrister Constance Cassidy has come out in favour of the bar saying they didn’t break any laws.
Sligo-based Ms Cassidy, an expert on commercial law, told RTE’s Drivetime that O’Flaherty’s were not breaking any laws by operating a delivery service.
She said that as long as the delivery drivers were not accepting money then the operators were acting within the law.
Ms Cassidy went as far as to say that the pints did not even require to be sealed when being delivered.
