A man who sexually assaulted his intoxicated victim has been jailed for more than two years.
Thomas Devine, appeared at Letterkenny Circuit Court after pleading guilty to the attack which happened in 2015.
The court heard how Devine, aged 51, of Meenbanad, Dungloe, “took advantage” of the person during the incident on November 22, 2015.
Judge John Aylmer said there had been no violence during the assault.
He added “The victim was taken advantage of while somewhat intoxicated.”
He added that his local community now treat him as a “social pariah.”
The court was told that Devine was brought back to the jurisdiction through a European arrest warrant after he had absconded.
Barrister Peter Nolan said his client had already spent tie in custody for his crime.
The court was told a Probation Report on Devine found that he was at a low risk of reoffending.
He had no previous convictions and had now been placed on the Sex Offenders Register.
Judge Aylmer jailed Devine for two years and three months and backdated the sentence to when he entered custody.
