When Gardai stopped McDonagh, of the Big Isle, Manorcunningham, they noticed his passenger was not wearing a seatbelt.
Garda Inspector Sean Grant said the accused became quite aggressive and said he wanted to get home before rolling the car forward to within an inch and a half of the Garda’s foot.
Solicitor Frank Dorrian said his client was having a bad day and that he had been unnecessarily stopped.
He had been anxious to get home to feed one of his children, the court heard.
Judge Paul Kelly fined McDonagh €150 for failing to stop and a charge of driving without reasonable care was struck out.
