A man who was driving past a group of cyclists spat at one of them and hit him in the face.
Keith Hanlon appeared at Letterkenny District Court today charged with assault and also using threatening and abusive behaviour.
Garda Inspector Sean Grant said there had been two sets out cyclists out for a spin near Ballybofey on July 30th, 2015.
Hanlon, aged 44, was a passenger in the car being driven by his 68-year-old mother at the time at Donegal Road, Ballybofey.
He rolled down the window and spat phlegm at the group hitting cyclist Damien McElhinney.
Further up the road he is accused of spitting at the group again and later stuck up his two fingers at them.
Solicitor for the accused, Mr Donagh Cleary said his client, from Dunwiley, Stranorlar, suffered from a medical condition and smoked a lot but had nothing against these men or cyclists in general.
Judge Paul Kelly asked Mr Cleary why his client spat at the group and described the incident as disgusting.
He fined Hanlon €250 for assault and took the charge of threatening and abusive behaviour into consideration.
