Man sent forward for trial for dangerous driving causing death

An Inishowen man has been sent forward to the Circuit Court charged with dangerous driving causing the death of a young Buncrana man.

Seosamh McGonigle, 20, from Glackmore, Muff, was charged with dangerous driving causing the death of John Hegarty [21] at Carnashannagh, Burnfoot, on July 12, 2015, when he appeared before Buncrana District Court.

The court heard that Garda Kelly served the Book of Evidence on McGonigle at 11.56am that morning at Buncrana Court House.

McGonigle, who was present with his father, Joseph, and dressed in dark jeans, a white shirt and a grey coat, did not speak during the brief hearing in Buncrana.

Garda Inspector David Murphy said the Director of Public Prosecutions had consented that the accused, Seosamh McGonigle, be sent forward to the next criminal sitting of Letterkenny Circuit Court.

Insp. Murphy said this commences on December 5, this year.

The Buncrana Garda Inspector said the case against McGonigle should proceed on charge number one in the Book of Evidence.

McGonigle is also accused of having no insurance and failing to produce his insurance at Carnashannagh, Burnfoot, on July 12, 2015, however, these will go ahead at the District Court.

Insp Murphy said these charges should be added to the indictment and adjourned until after the Circuit Court case.

Judge Paul Kelly told McGonigle that he has been returned for trial next December and warned him that if he wished to rely on an alibi as part of his defence he should inform the gardaí within 14 days.

He granted legal aid to McGonigle’s solicitor, Frank Dorrian and two counsel for the Circuit Court case and adjourned the remaining matters against the 20-year-old until the January sitting of court in Buncrana.

The accused was released on his continuing bail.
