A man stopped for suspected of drunk-driving called two female Gardai “fat prostitutes” and then spat into the urine sample he gave.
Mark Fair appeared at Falcarragh District Court charged with a number of offences.
The court heard the 26-year-old was stopped on suspicion of drink-driving at Gransha, Buncrana on August 15th, 2012.
However, Garda Inspector Denis Joyce said Fair hurled a litany of abuse and insults at the two female Gardai.
He said that Fair called the Gardai, “sluts, c***ts and fat prostitutes.”
When arrested, Fair kicked the side window of the patrol car and threatened to spit in the face of one fo the Gardai before calling her an “ugly c***.”
Fair, of Ballinahone, Fahan, was then given the option to give a specimen of his blood or urine but spat in the small amount of urine he provided and a proper test could not be carried out.
The court heard that Fair has a number of previous convictions including theft, public order, cruelty to animals and passing counterfeit currently.
He is currently on remand in prison facing other charges.
Solicitor Frank Dorrian said his client almost suffered from a “Tourette’s-like” condition when dealing with authority or when he had alcohol taken.
He said “When I meet him he is a very affable young man.”
Judge Paul Kelly described the names Fair called the Gardai as “outrageous and appalling.”
He fined Fair €250 for the public order offence and a further €300 and disqualified him from driving for four years for failing to give a sample.
A charge of criminal damage of the Garda patrol car was struck out and a charge of frustrating Gardai was taken into account.
