A 43-year-old Polish man ‘threw himself around, pretending to have a fit’, when taken into custody at Letterkenny Garda Station.
Letterkenny District Court was told that Robert Wesnawski, of 16 The Steeples, Ramelton, was observed driving a vehicle that connected with a kerb at Oldtown, Letterkenny before turning onto Pearse Road without signalling by Garda Kilcoyne.
Garda Kilcoyne pulled the vehicle over and formed the opinion that Wesnawski was under the influence of alcohol.
“He head-butted a locker and he became very aggressive,” Inspector Goretti Sheridan told the Court, adding that Wesnawski refused to give a blood sample while being processed.
“He threw himself around, pretending to have a fit. He head-butted a chair and refused to give a sample when being processed.”
Defending solicitor, Kieran Dillon, said his client had ‘made some bad decisions’.
“He was at a social gathering and felt that he was able to drive. He was handcuffed and he felt that there was no need. He felt that it wasn’t necessary, but he took a difficult approach to it.
“Some bad decisions were made and he didn’t do things as he should have.”
Judge Paul Kelly said he took Mr Wesnawski’s early plea and his previous good character into account.
“His behaviour on the night is not something that he can be proud of.”
Mr Wesnawski was fined €350 and disqualified from driving for four years.
