Child awarded more than €30K after car rear-ended in icy conditions

A 12 year old child whose family car was rear-ended is icy conditions has been awarded more than €30,000 in damages.

Letterkenny Circuit Court heard the accident happened in Letterkenny in November last year.

The child, who is now in sixth class, was a backseat passenger in a car being driven by her mother when they were struck from behind.

The child had pain in both her chest and neck and had to receive physio twice a week for a number of months after the accident.

The child continued to complain of chest pain and her mother took her to a cardiologist in Lithuania but the child was given the all-clear.

The child also suffered from bed wetting and anxiety after the crash.

However Letterkenny Circuit Court was told the child has now come on “leaps and bounds” and enjoys plenty of hobbies and the family are happy with the offer.

Judge John O’Hagan described the offer as “excellent” and recommended the settlement of €31,357 which includes €3,357 in special damages.

He ordered the money be lodged with the accountant at the Four Courts until such time as the child reaches 18.
