The Director of PUblic Prosecutions is continuing with its prosecution of an 82-year-old woman for careless driving causing the death of a motorcyclist.
Moira Edwards, 82, of Mullaney, Burt, was charged with careless driving causing the death of Lenny Nelson at Lisfannon, Burt on October 30, 2014.
Defence solicitor Ciaran MacLochlainn said he made representations to the Director of Public Prosecutions about Ms. Edwards and asked them to ‘take a certain course’ but they refused.
Garda Inspector David Murphy said they referred the case back to the DPP but added that the Director was confident in continuing with the prosecution against Ms. Edwards.
Furthermore, Insp. Murphy revealed that the DPP were only happy for the case to proceed at the District Court on the basis that Ms. Edwards pleads guilty. He said if the 82-year-old wished to contest the charge against her she would have to do so before a judge and jury in the Circuit Court.
Solicitor MacLochlainn said they would need to look at the statements and consider their position before making a decision.
“We’ll have to deal with it,” he added.
Judge Paul Kelly granted a statements order for Mr. MacLochlainn and adjourned matters until February 9, 2017.
