DRUNKEN MAN ENTERED TAKEAWAY AND SMASHED GLASS ON DISPLAY FRIDGE

A man who caused criminal damage in a popular takeaway after a all-day drinking spree has been fined at a sitting of Letterkenny District Court.

Anthony McVeigh, 28, with an address at Drumany, Kerrykeel is currently residing in Australia.

The incident occurred on the 18th of December, 2015 – when the defendant was back home in Donegal for the Christmas holidays.

Mr McVeigh’s sister appeared on his behalf in court in relation to the incident.

The court heard how Gardaí were called to Sultans Takeway, Port Road, Letterkenny in the early hours of the 18th of December.

The court were told that two intoxicated males entered the takeaway – and were acting aggressively.

They became embroiled in an altercation and a row broke out – Mr McVeigh then smashed the glass on a display fridge in the takeaway.

He then left the takeaway but was identified later in another takeaway by the owner of Sultans Takeaway – Mr Sofiame Bounaaja.

Mr McVeigh was then arrested and charged with criminal damage.

Solicitor for the defendant Patsy Gallagher told the court, “My client is currently in Australia, where he is working and living – and isn’t present in court.

“His sister is here on his behalf and has €800 which Mr McVeigh left with her to pay for the damage he caused.

“He regrets his actions on the night in question, and alcohol was a big factor in the incident.

“He has no previous convictions.

Judge James Faughnan commended Mr McVeigh for wanting to deal with the matter now – despite the fact he was in Australia, adding that he could’ve dealt with the matter when he was home next.

Judge James Faughnan accepted the €800 the defendant offered to the owners for the criminal damage caused and ordered a probation report on Mr McVeigh.
