A judge told a Newmills man that he had a very casual attitude to the road traffic act.
Noel Devine was before Letterkenny District Court on a charge of holding a mobile phone while driving on April 20th this year.
Devine, of Kirkneedy, Newmills told the court he never received a ticket for the offence and only knew about it when he got a summons to appear in court.
He said he did not think it was his vehicle as it had been off the road on two occasions this year.
However a picture of the vehicle was captured by a camera and shown in court as evidence. Devine could be seen in the picture, driving the vehicle.
Devine, 43, accepted it must have been his vehicle and said it would not happen again as he had now invested in a hands-free phone kit.
Judge Paul Kelly fined Devine €250 but warned him he will go off the road if he is caught again.
