Gardai have changed the locks at a house of a dead Church of Ireland Minister after a family living illegally at the house fled.
The house at Rooskey, Newtowncunningham has been at the centre of a court battle for the last few months.
The house was left to charity by the late Church of Ireland Minister Samuel Reede after he died in 2010.
However when estate agents called to the house in February, they found the locks changed and a ‘No Trespassing’ sign up.
A man known only as John Doe eventually appeared in court in July and claimed he had deeds to the house and had paid a deposit.
The case was adjourned until today after Gardai called to the house yesterday looking for Daniel Green aka John Doe, who was living at the house.
Judge Petria McDonnell yesterday ordered Gardai to break down the door of the house at 8.30am this morning if necessary in order to bring Green to court today.
Solcitor Fiona Brown called to the house yesterday to serve a notice of motion on Green and was met by his partner Marikie.
However, when Gardai arrived at the house this morning there was nobody in the house.
A locksmith has changed the locks and the house has been secured.
The court was told that belongings of Mr and Mrs Green were still in the house.
However barrister Fiona Crawford said there were fears that Green could return to the house and change the locks as he has allegedly previously done.
Judge Petria McDonnell adjourned the case until Friday to see if there any developments in the case.
