DISQUALIFIED DRIVER PLEADS GUILTY TO BEING DRUNK DURING DEATH CRASH

A Drumkeen man has admitted being drunk and already disqualified from driving when he caused the death of another man.gavel1

Barry McFadden appeared before Letterkenny Circuit Court.

McFadden pleaded guilty to five different charges which resulted in the death of Stephen McElwaine on June 16th, 2012.

The court heard that McFadden was driving a car which crashed at Balynaglack, Stranorlar which resulted in the death of Mr McElwaine.

Mr McElwaine, then 34 and from Convoy, was a passenger in the van which overturned.

Wearing a dark shirt and dark trousers, McFadden replied ‘guilty’ to all charges which were put to him in court.

Among the charges were dangerous driving causing death, drink-driving, driving without insurance, driving while disqualified and driving a defective vehicle.

McFadden has been ordered to sign on twice weekly at Ballybofey Garda station after the case was put back for sentence in October.

A probation and welfare report has also been ordered on the accused.

Ms Patricia McLaughlin said the victim’s family did not wish to read out a victim impact report at this time.
