Double-killer John Gallagher made the shape of a gun with his finger to his brother and pulled the trigger on two consecutive days, a court heard today.
The alleged incident happened on May 13th and 14th last outside of Gallagher’s brother Donal’s place of work in Strabane, Co Tyrone.
Gallagher, who wore jeans and a hooded top, appeared at Strabane Magistrates Court charged with harassment and making threats to kill.
The court had been adjourned from last week to fix bail conditions.
The conditions are that John Gallagher not have contact with his brother Donal and also that he should not film him.
The court heard that Gallagher, 47, from Grangewood, Strabane pulled up across from his brother’s place of work near the Argos store in Strabane.
It was alleged that he made the shape of a gun with his hand and pulled the trigger on two consecutive days.
It was also alleged that John Gallagher was filming his brother Donal from within the van.
Solicitor Oliver Roche told the court that John Gallagher did have video equipment in his van.
H said the reason for that was because several malicious allegations had been made against his client.
Investigating PSNI officer Constable Charlotte Church confirmed that video-equipment had been found in John Gallagher’s van.
It was examined but it did not show John Gallagher making the alleged gestures.
However it did show the location where it was claimed the incident had taken place.
Solicitor Oliver Roche said the last sitting of the court had requested contact be made with Gardai in Lifford concerning evidence of a video tape.
He claims this tape contains evidence that John Gallagehr’s brother Donal approached him and harassed him during an incident in Lifford some months back.
However this contact had not been made and the videotape had not been produced.
District Judge Paul Copeland said he was not making a decision on the bail condition
The court heard there had been allegations made by both sides including Mr Gallagher’s mother who had taken out a safety order against some of her own family.
He adjourned the case until June 13th to hear another bail application.
A full file on the case will be heard on July 10th next.
